Terms of sale

1. Scope

These terms apply to any purchase of a digital product (plugin, scenery, aircraft, helicopter, livery, utility for flight simulators) made on guilbair.fr or in Guilb'Air App. The terms in force on the day of the order apply; you accept them by placing your order.

2. Who sells

Each product shows its seller on its page, in the cart and at checkout: "Sold by Guilb'Air" or "Sold by [developer name], via Guilb'Air".

A developer's products

The independent developer shown on the product page, a member of the Guilb'Air team. They are the seller and receive your payment directly. Guilb'Air acts in their name and on their behalf to present the product and deliver your licence and download, without receiving any payment.

3. Products

They are digital content supplied without a physical medium. Their main features (compatible simulator, content, useful configuration) are shown on their page. Before buying, check that they suit your simulator and computer.

4. Prices

Prices are in euros, all taxes included: the price shown is the price you pay. Guilb'Air products: VAT not applicable, article 293 B of the French General Tax Code. A developer's products: price set by the developer, under their own tax situation.

Loyalty points: each euro paid on the site earns 1 point; 100 points give €5 off, up to half the price.

5. Order and payment

• You need a Guilb'Air account with a verified e-mail address.
• On the checkout page, just before paying, you tick the box requesting immediate access to the product (see article 11). Payment is not possible without it.
• Payment is made by card, through Stripe. Guilb'Air never sees or stores your card details.
• A developer's product: the payment goes straight to the developer's Stripe account. A cart holding products from several sellers is paid with one payment per seller.
• The sale is concluded once the payment is confirmed.

6. Delivery

Delivery is immediate after payment: the licence key appears in your space ("My space" on the site, "My add-ons" in the app) and is sent to you by e-mail with the order summary. Downloading or installing is done from your account, and for some products with Guilb'Air App for Windows.

If your licence doesn't arrive, write to contact@guilbair.fr: Guilb'Air handles it, whoever the seller is.

7. Licence

You don't buy the software itself: you buy a personal, non-exclusive, non-transferable licence to use it, tied to your account, for your own use. The author keeps all rights in the product (articles L122-6 and following of the French Intellectual Property Code).

Each licence can be activated on a limited number of computers, set for each product and shown in "My computers". You can release a computer yourself (new PC, failure, theft) up to 3 times per month per key; beyond that, support does it for you.

Updates are reserved for valid licences used in accordance with these terms.

Statutory exceptions, in particular those of article L122-6-1 of the French Intellectual Property Code (backup copy, interoperability), remain applicable.

8. Protection and unlawful use

The same licensing and protection system applies to Guilb'Air's products and to those of team developers. You may not:

• share, lend, resell or publish your licence key or the product files;
• bypass, disable or modify the protection, or decompile the product to "crack" it, outside the exceptions provided by law;
• use the product beyond what your licence allows.

9. What the protection system does

• Activation: the licence is checked and linked to a fingerprint of the computer.
• Marking: delivered files may contain an invisible mark specific to your licence (in some images and some text files), which makes it possible to trace the original licence of an unlawfully shared copy.
• Logs: the licence and update servers record checks and downloads.
• These processing operations are described in the privacy policy. They rely on the performance of the contract and on the legitimate interest in protecting software.

10. In case of unlawful use

If unlawful use is found (sharing of the product or key, cracking attempt), the seller, or Guilb'Air on their behalf, informs you by e-mail; you have 8 days to explain. The licence may be suspended during that time, and immediately in case of obvious sharing. If the unlawful use is confirmed, the licence is revoked without refund and updates are blocked. The seller may also take legal action.

11. Right of withdrawal

The products are digital content supplied immediately. Before paying, you expressly request immediate access and acknowledge that you lose your right of withdrawal once the download or activation begins (article L221-28 13° of the French Consumer Code). This consent is recorded with its date and repeated in the confirmation e-mail.

12. Legal guarantee of conformity

The seller is liable for any lack of conformity of the product under articles L224-25-12 and following of the French Consumer Code. In case of a defect, you may ask for the product to be brought into conformity; failing that, for a price reduction or the cancellation of the sale, under the conditions and time limits set by these articles.

14. Liability

To the extent permitted by law, the seller is not liable for a malfunction caused by a configuration or simulator not listed on the product page, by a third party's modification of the product, or by use contrary to these terms. Guilb'Air is responsible for the operation of the site and the delivery of licences and downloads; the developer is responsible for the content of their products. Nothing in these terms limits your statutory consumer rights.

15. Complaints and mediation

Write to contact@guilbair.fr first: we handle your request or pass it on to the seller concerned. If no solution is found, you may use a consumer mediator free of charge (article L612-1 of the French Consumer Code).

17. Governing law

These terms are governed by French law, without depriving you, as a consumer, of the protection of the mandatory rules of your country of residence. In case of dispute, you may go to the court of your place of residence or that of the seller.
